What are tenants' rights regarding mould growth?
As a tenant, if you are dealing with mould issues in your rental property caused by inadequate insulation or faulty heating, your landlord may bear responsibility for remediation and repairs.
In 2018, an amendment to the Landlord and Tenant Act of 1985 granted tenants the right to seek legal help if they believe their rental unit is "unfit for human habitation." If your home is unsafe due to dampness or mould, the responsibility falls on your landlord to rectify the problem.
However, they can only address the issue if they are made aware of it. Therefore, it is essential to report the problem to your landlord as soon as you suspect it is adversely affecting your health or the well-being of your family.
