Mould exposure can cause long-term health problems if not dealt with immediately.
Mould produces allergens, irritants, and occasionally toxic substances. Inhaling, ingesting and touching mould can trigger several health problems ranging from an allergic reaction and respiratory infections to more serious issues, like sick building syndrome and fatal asthma attacks.
Some people are particularly vulnerable to mould including elderly people, young children, people with pre-existing respiratory conditions, and people with weakened immune systems. Thorough, prompt removal is essential to protect people’s health against the harmful fungus.
Is your landlord responsible for preventing mould growth?
In instances where structural issues result in rising or penetrating damp, it is up to the landlord to rectify these problems. This obligation is clearly outlined in section 11 of the Landlord and Tenant Act 1985.
However, when condensation or poor ventilation occurs due to tenant behaviour, the responsibility shifts to the tenant. In such cases, a court can determine whether mould in a property is caused by the tenant or the structural issues of the property.
The responsibility to address mould issues in a rental property can be a complex legal matter, and it is tactful for both landlords and tenants to be aware of their respective obligations in this regard.
